Join Magistrate Porter, Supervising Magistrate, Assessment and Referral Court (ARC), with panel members Carrie O’Shea, Associate Director, Summary Crime, Victoria Legal Aid, and Leah Vincent, Psychologist, Principal Practice Lead, Court Support Services, Magistrates’ Court of Victoria, for a session on mental health and the criminal justice system. This session explores options available for those with complex mental health when they are before the Court, including best practice for lawyers and the referral pathways available.
The Royal Commission into Victoria’s Mental Health identified that people living with mental illness are over-represented in the criminal justice system and do not get the support they need. A key recommendation of the Royal Commission is the expansion of the Assessment and Referral Court in the Magistrates’ Court of Victoria.
It is likely that practitioners will, as the Court does, interact with accused that present with complex mental health needs. There are a number of different referral pathways and specialist courts and programs at the Magistrates’ Court which can assist an accused through the court system.
