The LIV welcomes the review of the re-opening and appeal process for coronial investigations outlined in the Coroners Act 2008 (Vic) (the Act). The LIV’s comments in its submission to the Coronial Council of Victoria are made in light of the recent history of Victorian coronial legislation, and the operation of the coronial appeals and re-opening processes in other Australian jurisdictions.

This submission has been prepared by members of the LIV’s Criminal Law Section with contributions from the Litigation Lawyers Section. The LIV Criminal Law Section, which is comprised of more than 2500 members, has a long history of contributing to, shaping and developing effective criminal legislation, and has undertaken extensive advocacy on law reform and policy issues.
