The LIV has written to the Chief Magistrate, the Hon. Lisa Hannan, to express concerns that victims of elder abuse are at times being placed at a severe disadvantage and risk by the misuse of the FVIO system designed to protect them.

The letter contains several case studies detailing instances where an vulnerable elderly party has been disadvantaged or subjected to greater risk due to the misuse of a family violence intervention order in the Magistrates' Court. In response to these case studies, the LIV Elder Law Comittee have proposed six key recommendations.

This letter follows consultaitons with Melbourne Magistrates' Court staff, and the LIV welcomes an opportunity for further consultation.
