      Over the past few years, the LPLC has seen a rise in claims resulting from practitioners acting in commercial litigation. In 2019–2020 commercial litigation was the second highest area of law for claims at 18%, with property and conveyancing at 27%.

      Getting the basics wrong in commercial litigation can lead to big ramifications for both client and practitioner. Through the use of real-life case examples, this session will offer insights into the issues you should look out for and provide essential tips for managing risks when acting for clients in litigation.

      • Errors such as jurisdictional limits and misnaming parties to a proceeding
      • Failing to keep proper records of advice provided
      • The importance of communication with your client including written merits advices, what they should include and when they should be provided or updated

    Make your points count with the LIV

    To maximise flexibility and support you in fulfilling your CPD requirements for the 2020/21 practising year, the LIV has expanded its usual February and March CPD program to begin November 2020.

    The convenient online program is divided into two parts:

    • Part 1 ran from November to December 2020. Recordings of part 1 sessions will be available for purchase on the LIV site, allowing you to earn CPD points in your own time, at your own pace.
    • Part 2 runs from February to March 2021. It contains 22 sessions across 14 practice areas and features the established CPD intensives and conferences you've come to expect, as well as a blend of live webinars and recordings of previous LIV CPD.

    As with all LIV professional development, this program has been developed in collaboration with LIV committees and industry experts.
